Default "Ownership" verses "Guardianship"

As most of you have heard this issue has come up on our calls a couple of times...and me being me has stepped up and put my 2 cents in. This issue has been fought for many years by many poeple. I'm a little late getting in the ballgame, but here's why, because the ball game is now heating up and this could now pass. They have gotten it to pass in several states, towns and cities. It could change things for all of us.

With out me going into it....I'm looking more for answers from you, on these questions:

What do you know about it?
Is this a issue you are aware of? If so how much?
Do you want to know more about it?

I want to know your concerns, not mine, as I want to address on our platform what is most needed for bird owners everywhere.

I am assuming you are referring to the legal difference of ownership verse guardianship??? In which if pets are owned than the animal has no rights, but it does not limit the owners choices in terms of care, and that guardianship translates into your pets has almost the same rights as children? Where the welfare of your bird is monitored, so to speak, and a sort of social services for animals can rip your pet from you when they think you do not care for your pet.

If that is so, than to me legal guardianship as it would apply to animals scares me. As it could mean you don't clip your bird to safe guard it so we are taking your bird away. with so many different and valid ways of raising animals, it think it is too blurry of a line to judge and will be taken to the extreme.

I understand the argument for guardian ship status as it would mean stricter laws regarding animal welfare in hopes of curtailing some abuse, but.......I don't think us humans are capable of instituting it well enough as to not take away animals from good caring people who take care of their animals.

Guardianship of a animal sounds all warm and fuzzy vs. Ownership which represents that an animal is property, doesn't it? What concerns me is people not knowing that this is far more than simple terminology. Guardian is a legal term and Guardianship law has significant legal implications, restrictions and expectations.

I am not sure exactly what it is they are proposing to do, but over here the government have the right to fine you or put you in prison if you don't look after your animal properly basically.

Here's a quote from the defra website:

It makes owners and keepers responsible for ensuring that the welfare needs of their animals are met.

These include the need:

For a suitable environment (place to live)
For a suitable diet
To exhibit normal behaviour patterns
To be housed with, or apart from, other animals (if applicable)
To be protected from pain, injury, suffering and disease

The law also increases to 16 the minimum age at which a person can buy an animal and prohibits giving animals as prizes to unaccompanied children under this age.

Anyone who is cruel to an animal, or does not provide for its welfare needs, may be banned from owning animals, fined up to £20,000 and/or sent to prison.
I don't know if this is something like what they are saying over there? I apologise if it is completely irrelevant.

No your laws in the UK will look like childs play.
We are heading there and then some, hiding behind legal terms is banning, imprisonment, fine and all.

I don't want to go into it now, I just want to see who is aware, who wants to be and if it is a subject that you would like to know more on.

I can't say that I've heard or read much about it, or to what stage it may have progressed. Sounds like something we need to be educated about.
